Guarantee terms

Lexmark guarantees to the original end user purchaser and to any person to whom the Product is given or sold during guarantee with the original proof of purchase (hereafter user), that the Product is manufactured from new or equivalent to new used parts, conforms to Lexmark published specifications, is free from defects in materials and workmanship and is in good working order at delivery. Lexmark also guarantees to provide certain Technical support to the user.

This limited Lexmark Guarantee is in addition to any legal Warranty that the user may be able to receive from the seller under applicable local law. Guarantee service will be provided by Lexmark or a Lexmark local representative for a period one year from the date of purchase (hereafter referred to as Lexmark). Lexmark does not warrant uninterrupted or error free operation of the Product.

During the term of this Guarantee Lexmark will:

  • provide technical support to the purchaser to determine if the Product is defective and if so why and
  • repair or replace a Product that is defective or ceases to function except as excluded herein.

The term of this Guarantee for Products, Original toner supplies and Original Inkjet supplies shipped with Products is as follows:

  • One year from the date of purchase for Products (which include laser, inkjet, serial dot matrix and multifunction printing Products)
  • Lifetime for toner supplies(s). Lifetime is defined as the period from date of purchase until the original toner placed in the cartridge by Lexmark is depleted to the point where the supply no longer functions.
  • Ninety days from the date of purchase for inkjet supplies.

This Lexmark guarantee does not apply to software, printing media or other items shipped with any Product.

Software, printing media or other items distributed by Lexmark as part of the Product purchase or package are guaranteed as set forth in the documentation, end-user license agreement or packaging of said items.

Guarantee service and Technical support will be provided by technical support agents who can be contacted by telephone, fax or email. To receive Guarantee service or Technical support the user must be able to provide the serial number, date and purchase location when requested to do so. Lexmark reserves the right to request the original sales receipt, showing the serial number and date of purchase. Without such information the Product may be deemed to be “Out of Guarantee” and therefore any service provided would only be provided at the current service or technical support rates.

When providing Guarantee service Lexmark will first attempt to diagnose and rectify the reason why the Product may be defective or not functioning over the Telephone, the Internet or by Fax. Lexmark will repair or replace a defective or not functioning Product by either providing a new or refurbished replacement Product. Lexmark technical support agents will provide instructions relating to the return or replacement of defective or not functioning Products. Depending on the product, return may be to the point of purchase or to another location that will be specified. Return can be at purchaser’s expense. Original packing materials should be retained for potential use during the guarantee period. All exchanged parts and Products replaced under Guarantee services become the property of Lexmark. The delivery of a replacement Product does not extend the guarantee period.

In the event of an exchange with a replacement Product, the defective or not functioning Product is to be delivered to the carrier or promptly returned in the packing materials provided with the replacement Product. Failure to return the defective Product will result in an invoice for the replacement Product at Lexmark then current published list price. Lexmark reserves the right to request user credit card information and to debit the credit card in the event the defective or not functioning Product is not returned within fifteen calendar days. A replacement Product before it is returned and used on the Replacement Product.

Guarantee service does not include repair or replacement of Products caused by:

  • modifications of or attachments to the product
  • accidental damage or misuse
  • electrical surges including lightning
  • usage higher than set forth in Lexmark specifications
  • operational environments not within Lexmark specifications for temperature, air or humidity
  • maintenance or repair by other than Lexmark authorized Service providers, and
  • use of other than original ship with or replacement Lexmark supplies refilled by user or a third party.

Guarantee service will not be provided for Toner or Inkjet supplies which are refilled by user or a third party or cease to function because of accidental damage or misuse.

To maintain optimum performance, some printer Products may require maintenance kits on reaching a certain amount of prints. This is notified in applicable Product specifications and installation materials. Purchase and installation of maintenance kits are not covered by this guarantee. Service interventions directly caused by user failure to use a recommended maintenance kit are not included in this guarantee.

THIS STATEMENT OF LIMITED GUARANTEE IS THE EXCLUSIVE GUARANTEE.

ALL OTHER EXPRESS OR IMPLIED GUARANTEES INCLUDING THE IMPLIED GUARANTEES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXCLUDED. (EXCEPT WHERE SAID IMPLIED GUARANTEES ARE REQUIRED BY APPLICABLE LAW).

NO GUARANTEES EITHER EXPRESSED OR IMPLIED WILL APPLY AFTER THE EXPIRATION OF THE GUARANTEE PERIOD.

LIMITATION OF LIABILITY

The Purchaser’s sole remedy in the event a Product is defective or ceases functioning is the Guarantee service set forth above. Even in the event of a Breach of this Guarantee, Lexmark sole and exclusive Liability for actual damages of any kind is limited to the price paid for the Product, its repair or replacement. This limitation of Liability for actual damages does not apply to bodily injury or property damage for which Lexmark is held legally liable. In no event will Lexmark be liable for lost profits; incidental or consequential damages even if advised of the possibility of said damages.
